Noida Workers’ Movement Case: 16-Year-Old Minor Released from Juvenile Home

New Delhi: The 16-year-old minor arrested in the Noida workers’ movement case was released from the juvenile home on Thursday (May 18). The minor had been kept in the juvenile home for the past six days. Before that, he had been held in jail with adult accused persons for two months. His bail amount was reduced from 45,000 rupees to 30,000 rupees, against which the papers of a motorcycle were deposited in court as surety.

नई दिल्ली: नोएडा श्रमिक आंदोलन मामले में गिरफ़्तार 16 वर्षीय नाबालिग को गुरुवार (18 मई) को जुवेनाइल होम से रिहा कर दिया गया. नाबालिग को पिछले छह दिनों से जुवेनाइल होम में रखा गया था. इसके पहले दो महीनों तक उन्हें वयस्क आरोपियों के साथ जेल में रखा गया था. उनकी जमानत राशि 45 हज़ार रुपए से घटाकर 30 हज़ार रुपये कर दी गई, जिसके बदले एक मोटरसाइकिल के कागज़ अदालत में जमानत के तौर पर जमा किए गए.

The Wire Hindi had on Tuesday (June 16) published a report concerning the arrest of Nitin (name changed). Nitin was taken into custody from Noida’s Bhangel area on April 14 in connection with the Noida workers’ movement. His Aadhaar card records his age as 16; nevertheless, he was kept in an adult prison for nearly two months. Later, an ossification test, used to estimate age, also assessed his age as 16.

द वायर हिंदी ने मंगलवार (16 जून) को नितिन (बदला हुआ नाम) की गिरफ्तारी से जुड़ी खबर प्रकाशित की थी. नितिन को नोएडा मजदूर आंदोलन के संबंध में 14 अप्रैल को नोएडा के भंगेल इलाके से हिरासत में लिया गया था. नितिन के आधार कार्ड में उनकी उम्र 16 वर्ष दर्ज है, इसके बावजूद करीब दो महीनों तक उन्हें वयस्कों के जेल में रखा गया. बाद में ओसिफिकेशन (अनुमानित उम्र का पता लगाने के लिए किया जाने वाला जांच) जांच में भी उनकी उम्र 16 वर्ष आंकी गई.

According to Nitin’s lawyer, the documents relating to his arrest and remand recorded his age as 25. That was why he was initially sent to jail as an adult accused.

नितिन के वकील के अनुसार, गिरफ्तारी और रिमांड से जुड़े दस्तावेज़ों में उसकी उम्र 25 वर्ष दर्ज की गई थी. यही कारण था कि उन्हें शुरू में वयस्क आरोपी की तरह जेल भेजा गया.

Nitin’s lawyer, Manik Gupta, told The Wire Hindi, “Nitin received a phone call on April 14 and was told that a parcel had arrived for him. He said he had not ordered any parcel, but even then he was asked to come outside. According to Nitin, when he reached the place he had been told to go, the police were present there and took him away with them.”

नितिन के वकील माणिक गुप्ता ने द वायर हिंदी को बताया, ‘नितिन को 14 अप्रैल को एक फोन कॉल आया और कहा गया कि उसका कोई पार्सल आया है. वह उसने कहा कि उसने कोई पार्सल नहीं मंगाया है, तब भी उसे बाहर आने के लिए कहा गया. नितिन के अनुसार, वह जब बताए गए स्थान पर पहुंचा तो वहां पुलिस मौजूद थी और उसे अपने साथ ले गई.’

After this, having been kept in jail with adults for nearly two months, he was transferred to a juvenile home on Friday (June 12). The certificate from his ossification test, used to estimate age, had been issued on June 6; even after it established that he was a minor, he was kept in jail for six days.

इसके बाद करीब दो महीनों तक वयस्कों के साथ जेल में रखे जाने के बाद शुक्रवार (12 जून) को उन्हें किशोर गृह (जुवेनाइल होम) में स्थानांतरित किया गया. 6 जून को उनकी ओसिफिकेशन (अनुमानित उम्र का पता लगाने के लिए किया जाने वाला जांच) जांच का सर्टिफिकेट जारी किया गया था, जिसमें नाबालिग साबित होने के बाद भी उन्हें 6 दिन तक जेल में रखा गया.

Nitin’s lawyer and his brother Dinesh say that he was also beaten after being taken into custody.

नितिन के वकील और उनके भाई दिनेश का कहना है कि हिरासत में लेने के बाद उनके साथ मारपीट भी की गई.

The application filed before the Juvenile Justice Board records that after Nitin was arrested, neither was his family informed nor was he allowed to contact a lawyer. The application says that about a month after his arrest, on May 15, his current lawyer met him, and only then did he receive legal representation.

जुवेनाइल जस्टिस बोर्ड में दायर आवेदन में यह दर्ज है कि नितिन को गिरफ्तार किए जाने के बाद न तो उनके परिवार को इसकी सूचना दी गई और न ही उन्हें किसी वकील से संपर्क करने दिया गया. आवेदन में कहा गया है कि गिरफ्तारी के लगभग एक महीने बाद 15 मई को वर्तमान वकील की उनसे मुलाकात हुई और तब ही उन्हें कानूनी प्रतिनिधित्व मिला.

The application also alleges that Nitin was produced in court in chains. Manik Gupta confirmed to The Wire Hindi that he himself saw Nitin bound in chains.

आवेदन में यह भी आरोप लगाया गया है कि नितिन को अदालत में जंजीरों से बांधे हुए पेश किया गया था. माणिक गुप्ता ने द वायर हिंदी से इस बात की पुष्टि की है कि उन्होंने ख़ुद नितिन को जंजीरों में बंधा देखा है.

It should be noted that chaining a minor in this manner is a violation of the juvenile justice law and the guidelines of the Supreme Court.

ज्ञात हो कि किसी नाबालिग को इस तरह से जंजीरों में बांधना किशोर न्याय कानून और सुप्रीम कोर्ट के दिशानिर्देशों का उल्लंघन है.

The court had granted bail on May 29.अदालत से 29 मई को मिली थी जमानत

On May 29, a sessions court in Gautam Buddha Nagar granted Nitin bail. In its order, the court said that Nitin’s name was not in the FIR. The court also noted that no CCTV footage, video, or photographic evidence had been placed on the record that would establish his specific role in the incident.

बीते 29 मई को गौतम बुद्ध नगर की एक सत्र अदालत ने नितिन को जमानत दे दी. अपने आदेश में अदालत ने कहा कि नितिन का नाम एफआईआर में नहीं था. अदालत ने यह भी नोट किया कि रिकॉर्ड पर ऐसा कोई सीसीटीवी फुटेज, वीडियो या फोटोग्राफिक साक्ष्य प्रस्तुत नहीं किया गया जिससे घटना में उसकी विशिष्ट भूमिका स्थापित होती हो.

The court further said that the statements of the prosecution witnesses on record do not clearly establish Nitin’s role. On this basis, the court approved the juvenile’s bail.

अदालत ने यह भी कहा कि अभियोजन पक्ष के जिन गवाहों के बयान रिकॉर्ड पर हैं, वे नितिन की भूमिका को स्पष्ट रूप से स्थापित नहीं करते. इसी आधार पर अदालत ने किशोर की जमानत को मंजूरी दी.

However, despite the bail order, Nitin was unable to get out of custody. According to the application filed before the Juvenile Justice Board, Nitin’s family is so poor that it could not arrange the two sureties of 50,000 rupees and the cash amount of 45,000 rupees required for bail.

हालांकि, जमानत आदेश के बावजूद नितिन हिरासत से बाहर नहीं आ पा रहे थे. किशोर न्याय बोर्ड में दाखिल आवेदन के अनुसार, नितिन का परिवार इतना गरीब है कि वह जमानत के लिए आवश्यक 50 हज़ार रुपये के दो जमानती और 45 हज़ार रुपये की धनराशि की व्यवस्था नहीं कर पा रहा था.
