كيف نفهم أجهزة الأمن التونسية وما الذي يقلقها هذه الأيام؟

في واحدة من أكثر الشهادات إثارة للاهتمام حول الدولة التونسية، برر مدير سابق للأمن الوطني كثيرا من الانحرافات الأمنية التي عرفتها البلاد، ليس بسلوك الأفراد، بل بما سماه "العقيدة الأمنية" التي حكمت المؤسسة لعقود.

In one of the more interesting testimonies about the Tunisian state, a former director of national security justified many of the security deviations the country had known not by the conduct of individuals, but by what he called the “security doctrine” that had governed the institution for decades.

قال الرجل تقريبا إن العقيدة السائدة كانت تقوم على معادلة واضحة: 90% من عمل الأجهزة دفاعا عن الدولة وأمنها، و10% دفاعا عن النظام. وربما يختلف كثيرون حول دقة هذه النسبة، بل قد يذهب بعضهم إلى اعتبارها معكوسة تماما. لكن الأهم من الأرقام نفسها هو الاعتراف بوجود عقيدة أمنية حكمت علاقة الأجهزة بالدولة والسلطة والمجتمع لعقود، وخلطت بدرجات متفاوتة بين حماية الدولة وحماية النظام القائم.

The man said, more or less, that the prevailing doctrine rested on a clear equation: 90 percent of the agencies’ work was in defense of the state and its security, and 10 percent in defense of the regime. Many may disagree over the accuracy of this ratio; some may even regard it as entirely inverted. But more important than the numbers themselves is the admission that a security doctrine existed, governing for decades the relationship of the agencies to the state, authority, and society, and conflating, to varying degrees, the protection of the state with the protection of the existing regime.

The Meaning of Security Doctrineمعنى العقيدة الأمنية

قد يبدو هذا الكلام، للوهلة الأولى، محاولة للتخفيف من مسؤولية الأجهزة في عقود القمع والانتهاكات. لكنه في الواقع يفتح بابا أعمق للنقاش:

At first glance, this may seem like an attempt to lessen the responsibility of the security agencies for decades of repression and violations. In reality, however, it opens the door to a deeper discussion:

ما هي العقيدة الأمنية فعلا؟.. كيف نشأت في تونس؟ وكيف تغيرت؟.. وهل نحن اليوم أمام عودة سريعة إلى عقيدة حماية النظام، أم أمام تحولات أعمق يصعب التراجع عنها؟

What, in fact, is security doctrine? How did it arise in Tunisia? How has it changed? And are we now facing a rapid return to a doctrine of protecting the regime, or deeper transformations from which it will be difficult to retreat?

الحديث عن "العقيدة الأمنية" لا يقتصر على التعليمات اليومية، أو على طبيعة القيادات الموجودة داخل الأجهزة. فالعقيدة الأمنية، في معناها العميق، هي مجموع التصورات التي تحدد: من هو العدو؟ ما الذي يجب حمايته؟ ما حدود استعمال القوة؟ وما طبيعة العلاقة بين الدولة والمجتمع؟

To speak of “security doctrine” is not merely to speak of daily instructions, or of the nature of the leadership within the agencies. Security doctrine, in its deeper sense, is the sum of the conceptions that determine: Who is the enemy? What must be protected? What are the limits on the use of force? And what is the nature of the relationship between state and society?

نشأت العقيدة الأمنية في تونس داخل دولة الاستقلال، في سياق بناء دولة مركزية قوية خرجت من الاستعمار وهي تخشى التفكك والجهويات والصراعات الأيديولوجية. ومع الوقت، اختلطت حماية الدولة بحماية النظام، ثم بحماية الحزب الحاكم وشخص الرئيس. هكذا تحول الأمن تدريجيا من وظيفة دستورية لحماية المجتمع والمؤسسات إلى أداة لضبط المجال السياسي، ومراقبة المجتمع، ومنع كل ما يمكن أن يفهم كتهديد لاستقرار النظام القائم.

Security doctrine in Tunisia arose within the post-independence state, in the context of building a strong centralized state that had emerged from colonialism fearing fragmentation, regionalism, and ideological conflict. Over time, protecting the state became mixed with protecting the regime, then with protecting the ruling party and the person of the president. Thus security gradually shifted from a constitutional function of protecting society and institutions into an instrument for regulating the political sphere, monitoring society, and preventing anything that could be understood as a threat to the stability of the existing regime.

في بعض الأنظمة، تبنى العقيدة الأمنية أساسا على حماية السلطة السياسية، ولو على حساب الحريات والقانون. أما في الأنظمة الديمقراطية، فتقوم العقيدة الأمنية على حماية الدولة والدستور والمجتمع، وعلى اعتبار المواطن صاحب حقوق، لا مجرد موضوع للمراقبة والسيطرة. ولهذا، فإن إصلاح العقيدة الأمنية لا يعني فقط تغيير القوانين أو الوجوه، بل يعني أيضا تغيير الثقافة السياسية التي تعرف معنى الأمن نفسه داخل الدولة.

In some regimes, security doctrine is built primarily on protecting political power, even at the expense of freedoms and the law. In democratic regimes, by contrast, security doctrine rests on protecting the state, the constitution, and society, and on regarding the citizen as a bearer of rights, not merely an object of surveillance and control. For this reason, reforming security doctrine does not mean only changing laws or faces; it also means changing the political culture that defines the very meaning of security within the state.

هذا السؤال ليس نظريا بالنسبة إلي. فقد كنت مشاركا في النقاشات التي رافقت صياغة دستور 2014، كما أشرفت إداريا بين أواخر 2011 ومنتصف 2013 على جهاز الأمن الرئاسي، في مرحلة دقيقة حاولت فيها الدولة التونسية إعادة تعريف العلاقة بين الأمن والجمهورية.

For me, this question is not theoretical. I took part in the discussions that accompanied the drafting of the 2014 Constitution, and between late 2011 and mid-2013 I administratively oversaw the presidential security apparatus, at a delicate stage in which the Tunisian state tried to redefine the relationship between security and the republic.

وأذكر جيدا كيف انتقل الأمن الرئاسي، خلال تلك الفترة، من عقيدة مرتبطة بحماية شخص الرئيس وعائلته، إلى عقيدة مرتبطة بحماية الدولة والمؤسسات. لأول مرة، أصبح الجهاز معنيا أيضا بحماية قيادات معارضة كبرى ومرشحين للانتخابات، وبضمان أمن المسار السياسي نفسه، لا أمن السلطة القائمة فقط.

I remember well how, during that period, presidential security moved from a doctrine tied to protecting the person of the president and his family to a doctrine tied to protecting the state and its institutions. For the first time, the apparatus also became concerned with protecting major opposition leaders and election candidates, and with ensuring the security of the political process itself, not only the security of the authority in power.

لاحقا، ومن خلال عضويتي في لجنة الأمن والدفاع بالبرلمان بين 2014 و2019، تابعت من قرب التحولات العميقة داخل المؤسسة الأمنية، بما فيها صراعاتها الداخلية، وهواجسها، وحدود الإصلاح الممكن فيها.

Later, through my membership in parliament’s Security and Defense Committee between 2014 and 2019, I closely followed the profound transformations within the security institution, including its internal conflicts, its anxieties, and the limits of possible reform within it.

The Revolution and the Transformation of Securityالثورة وتحول الأمن

في تقديري، لم تكن الدولة الأمنية في تونس كتلة واحدة متجانسة كما يصور أحيانا. بل كان هناك دائما تعايش بين "دولتين عميقتين" داخل أجهزة الدولة نفسها:

In my estimation, the security state in Tunisia was never the single homogeneous bloc it is sometimes portrayed as being. Rather, there was always a coexistence between two “deep states” within the state agencies themselves:

- دولة المصالح والشبكات والولاءات والانغلاق.

- A state of interests, networks, loyalties, and closure.

- ودولة أخرى تؤمن بالإصلاح، وبالحياد، وبالمصلحة العليا للدولة، وبفكرة الأمن الجمهوري.

- And another state that believes in reform, neutrality, the higher interest of the state, and the idea of republican security.

وقد استفادت المؤسسة الأمنية كثيرا من الثورة، أكثر مما يعترف به كثيرون.

The security institution benefited greatly from the revolution, more than many are willing to admit.

الثورة أعادت الاعتبار المعنوي والمادي للأمنيين، وأخرجت المؤسسة تدريجيا من المواجهة المباشرة مع المجتمع، وفتحت الباب أمام مناخات جديدة أكثر احترافية وأقل توترا. كما أن محاسبة بعض القيادات الأمنية بعد الثورة تركت أثرا عميقا داخل المؤسسة، خوفا من العقاب من جهة، ورسالة واضحة بأن زمن الحصانة المطلقة قد انتهى من جهة أخرى.

The revolution restored moral and material standing to security personnel, gradually extricated the institution from direct confrontation with society, and opened the door to new climates that were more professional and less tense. The accountability imposed on some security leaders after the revolution also left a deep mark inside the institution: fear of punishment on the one hand, and, on the other, a clear message that the age of absolute immunity had ended.

ثم جاء التداول السياسي السريع بين 2011 و2019 ليعمق هذا التحول. فالأجهزة التي رأت وزراء ورؤساء حكومات وأحزابا يتغيرون باستمرار، أصبحت أكثر حذرا من الاصطفاف السياسي، وأكثر ميلا إلى الاحتماء بالنص القانوني وبالحياد المهني.

Then the rapid alternation of political power between 2011 and 2019 deepened this transformation. Agencies that saw ministers, heads of government, and parties constantly changing became more cautious about political alignment, and more inclined to shelter behind the legal text and professional neutrality.

وتراجعت، نسبيا، بعض التجاوزات الجسيمة والممارسات الأكثر عنفا مقارنة بمراحل سابقة؛ بسبب تطور قيمي داخل جزء من المؤسسة، وبفعل الخوف المتزايد من المساءلة كذلك. وهاجس المحاسبة حاضر بقوة داخل أغلب القيادات الأمنية اليوم.

Some of the grave abuses and more violent practices declined, relatively speaking, compared with earlier phases, because of an evolution in values within part of the institution and also because of the growing fear of accountability. The anxiety over accountability is strongly present among most security leaders today.

لكن، سيكون من الخطأ تصوير هذا التحول وكأنه أصبح نهائيا أو مكتملا. فالإصلاح الأمني في تونس لا يزال هشا ومترددا وغير محسوم بالكامل، ولا تزال داخل المنظومة بقايا ثقافة قديمة قائمة على الغلق والولاء والخوف من الرقابة المدنية. كما أن بعض الانتهاكات والتجاوزات لم تختفِ تماما، خاصة في المناخات السياسية المتوترة، أو في الملفات ذات الطابع السياسي والأمني الحساس.

But it would be a mistake to portray this transformation as final or complete. Security reform in Tunisia remains fragile, hesitant, and not fully settled, and within the system there remain vestiges of an old culture based on closure, loyalty, and fear of civilian oversight. Some violations and abuses have not disappeared entirely, especially in tense political climates or in files of a sensitive political and security character.

غير أن الفارق الجوهري مقارنة بالماضي يتمثل في أن هذه الممارسات لم تعد تمارس داخل نفس مناخ الحصانة المطلقة، ولا بنفس اليقين القديم بأن الدولة ستوفر دائما الحماية لمنفذي التعليمات. وهذا، في حد ذاته، تحول عميق في العلاقة بين الأمن والقانون والمجتمع، حتى وإن بقي تحولا غير مكتمل وقابلا للانتكاس.

The essential difference compared with the past, however, is that these practices are no longer carried out within the same climate of absolute immunity, nor with the same old certainty that the state will always provide protection to those who carry out instructions. This, in itself, is a profound transformation in the relationship between security, law, and society, even if it remains incomplete and liable to reversal.

كثيرون من داخل الأجهزة يعتقدون أن من سيدفع الثمن القضائي عن مرحلة ما بعد 25 يوليو/تموز 2021 هم أساسا القيادة السياسية، وبعض الوزراء وفي مقدمتهم وزيرا العدل والداخلية الحاليان، وقرابة أربعين قاضيا من المتخصصين حصريا في القضايا السياسية والمنفذين للتعليمات الفوقية، وأربعة من القيادات العليا العسكرية والأمنية التي تورطت مباشرة في إدارة المرحلة. أما بقية الأجهزة، فهي حريصة، إلى حد بعيد، على تجنب التورط المباشر.

Many inside the agencies believe that those who will pay the judicial price for the post-July 25, 2021 phase are chiefly the political leadership, some ministers, foremost among them the current ministers of justice and interior, roughly forty judges specialized exclusively in political cases and in carrying out orders from above, and four senior military and security leaders who were directly involved in managing the phase. As for the rest of the agencies, they are, to a considerable extent, keen to avoid direct involvement.

ولهذا نلاحظ مفارقة مهمة: رغم الانغلاق السياسي الحالي، لا تزال قطاعات من المعارضة تشيد أحيانا باحترافية تعامل الأجهزة مع بعض التحركات الاحتجاجية، كما ينوه بعض الموقوفين السياسيين بطريقة التعامل الإنساني أثناء الإيقاف أو داخل السجون، مقارنة بمراحل سابقة من تاريخ الدولة التونسية.

This is why we observe an important paradox: despite the current political closure, sectors of the opposition still sometimes praise the professionalism with which the agencies handle certain protest actions, and some political detainees commend the humane manner of treatment during arrest or inside prisons, compared with earlier phases in the history of the Tunisian state.

ولا يقتصر اختبار العقيدة الأمنية الجمهورية على الملفات السياسية الكبرى أو على الصراع بين السلطة والمعارضة في العاصمة. فجزء مهم من هذا الاختبار يجري يوميا في الجهات، حيث تواجه الدولة احتجاجات اجتماعية واقتصادية مرتبطة بالتلوث في قابس، وبطالة أصحاب الشهادات، والماء، والتهميش التنموي.. هناك، يتحدد المعنى الحقيقي للأمن الجمهوري: هل يكون الأمن أداة لاحتواء الغضب الاجتماعي بالقوة، أم مؤسسة تحمي حق الناس في الاحتجاج، وتحافظ في الوقت نفسه على السلم العام والمؤسسات؟

The test of republican security doctrine is not confined to major political files or to the conflict between authority and opposition in the capital. An important part of this test takes place every day in the regions, where the state faces social and economic protests tied to pollution in Gabes, unemployment among degree-holders, water, and developmental marginalization. There, the true meaning of republican security is determined: Is security an instrument for containing social anger by force, or an institution that protects people’s right to protest while at the same time preserving public peace and institutions?

هذا التطور النسبي في السلوك الأمني يعكس تحولا حقيقيا، ولو بقي غير مكتمل وهشا، في العقيدة الأمنية، مقارنة بمراحل سابقة، ويؤكد أن قطاعات داخل المؤسسة لا تريد أن تتحول إلى ماكينة قمع، أو طرف مباشر في الصراع السياسي.

This relative development in security conduct reflects a real transformation, even if incomplete and fragile, in security doctrine compared with earlier phases, and confirms that sectors within the institution do not want to become a machine of repression, or a direct party to political conflict.

Anxieties After the Coupهواجس ما بعد الانقلاب

صحيح أن كثيرا من القيادات الأمنية كانت مرتاحة لما حدث ليلة 25 يوليو/تموز 2021. فقد شعرت أن الدولة استعادت نفسها من فوضى سياسية مرهقة، ومن محاولات بعض الفاعلين السياسيين توسيع الرقابة المدنية على الأجهزة بطريقة ارتجالية، أو توظيفها داخل معاركهم الخاصة.

It is true that many security leaders were comfortable with what happened on the night of July 25, 2021. They felt that the state had recovered itself from an exhausting political chaos, and from attempts by some political actors to expand civilian oversight over the agencies in an improvised way, or to deploy that oversight in their private battles.

كما أن نهاية مرحلة النقابات الأمنية، بكل ما حملته من فوضى وضرب للتراتبية والانضباط، كانت محل ارتياح داخل قطاعات واسعة من المؤسسة، خصوصا بعد إفشال مشروع قيس سعيد لتوحيد النقابات الأمنية داخل هيكل واحد موال للسلطة، كان يمكن أن يتحول عمليا إلى ما يشبه مليشيا سياسية حاملة للسلاح داخل الدولة. لكن من الواضح أيضا أن جزءا مهما من هذه القيادات غير مرتاح اليوم للوجهة التي ذهبت إليها البلاد.

The end of the phase of security unions, with all the chaos it brought and its blows to hierarchy and discipline, was also a source of relief within broad sectors of the institution, especially after the failure of Kais Saied’s project to unify the security unions within a single structure loyal to the authority, which could in practice have become something resembling an armed political militia inside the state. But it is also clear that an important part of these leaders is uneasy today about the direction the country has taken.

هناك قلق حقيقي من شخصنة الدولة، ومن إدارة المؤسسات بمنطق الولاء، ومن الحرص المحموم لجر أجهزة الدولة إلى معارك عبثية ضد الخصوم والمعارضين والإدارة.. وحتى ضد أجزاء من الدولة نفسها.

There is genuine concern over the personalization of the state, over the management of institutions according to the logic of loyalty, and over the feverish eagerness to drag state agencies into absurd battles against opponents, dissidents, the administration, and even against parts of the state itself.

كما أن استهداف عديد القيادات الأمنية لمرحلة ما بعد الثورة بدعوى علاقاتهم السابقة بفاعلين سياسيين قبل 2021 خلق خوفا إضافيا داخل المؤسسات، ورسخ قناعة بأن الولاء الشخصي لا يوفر دائما الحماية.

The targeting of numerous post-revolution security leaders on the pretext of their previous relationships with political actors before 2021 has also created additional fear inside the institutions, and entrenched the conviction that personal loyalty does not always provide protection.

والأهم من ذلك كله أن أغلب الأجهزة اليوم تخشى انهيار الدولة وانفلات المجتمع أكثر مما تخشى التغيير السياسي نفسه. فهي تدرك أن أخطر السيناريوهات ليس انتقالا منظما أو تسوية سياسية عقلانية، بل انتفاضة شعبية واسعة، غاضبة ومدمرة، بلا أفق سياسي واضح، وبلا أجسام وسيطة قادرة على امتصاص غضب الشارع وتأطيره.

Most important of all, most agencies today fear the collapse of the state and the unravelling of society more than they fear political change itself. They understand that the most dangerous scenario is not an organized transition or a rational political settlement, but a broad popular uprising, angry and destructive, with no clear political horizon and no intermediary bodies capable of absorbing and framing the anger of the street.

لذلك تبدو، في العمق، أقرب إلى تفضيل تغيير هادئ وعقلاني يحفظ الدولة ويمنع الانفجار، لكنها في الوقت نفسه لا تريد أن تتحمل مسؤولية أي انتقال سياسي جديد، ولا أن تظهر كطرف صانع للقرار.

For that reason, at a deeper level, they seem closer to preferring a calm and rational change that preserves the state and prevents an explosion. At the same time, they do not want to bear responsibility for any new political transition, nor to appear as a decision-making party.

وقد أثبتت تجارب الانتقال الديمقراطي، خصوصا في إسبانيا بعد فرانكو، أن استقرار الديمقراطية لا يقوم على الدساتير والانتخابات وحدها، وإنما كذلك على نجاح الدولة في إعادة تعريف وظيفة أجهزتها الأمنية: من حماية السلطة إلى حماية النظام الدستوري نفسه.

The experiences of democratic transition, especially in Spain after Franco, have shown that the stability of democracy does not rest on constitutions and elections alone, but also on the state’s success in redefining the function of its security agencies: from protecting authority to protecting the constitutional order itself.

وتونس، رغم خصوصياتها، تواجه اليوم السؤال ذاته: كيف ننتقل من دولة تخشى المجتمع، إلى دولة تحميه؟

Tunisia, despite its particularities, faces the same question today: How do we move from a state that fears society to a state that protects it?

الجواب لا يكمن في إضعاف الدولة أو في تسييس أجهزتها أكثر، بل في ترسيخ عقيدة جمهورية تجعل الأمن جزءا من الشرعية الدستورية لا أداة فوقها.

The answer does not lie in weakening the state or further politicizing its agencies, but in entrenching a republican doctrine that makes security part of constitutional legitimacy, not an instrument above it.

Toward Republican Securityنحو أمن جمهوري

وهنا يجب التوقف عند مسألة شديدة الحساسية: ما معنى "العقيدة الأمنية الجمهورية" أصلا؟

Here we must pause over an extremely sensitive matter: What does “republican security doctrine” actually mean?

لا علاقة لهذا المعنى بالتضاد الشكلي مع النظام الملكي. فالجمهورية هنا تعني، قبل كل شيء، خضوع القوة العامة للدستور والقانون، وارتباطها بالمواطنين لا بالحاكم، وبالمؤسسات لا بالأشخاص، وبالمصلحة العامة لا بالولاءات الخاصة.

This meaning has nothing to do with formal opposition to the monarchical system. Republic here means, above all, the subjection of public force to the constitution and the law, and its attachment to citizens rather than the ruler, to institutions rather than persons, and to the public interest rather than private loyalties.

في الدول الديمقراطية الحديثة، تقوم هذه العقيدة على فكرة بسيطة ولكن حاسمة: الأجهزة الأمنية والعسكرية ليست ملكا للحاكم، بل مؤسسات للدولة وللدستور وللمجتمع. لكنها، في المقابل، لا تتحول إلى وصي سياسي فوق الشعب، ولا إلى سلطة تقرر من يحكم ومن يعزل.

In modern democratic states, this doctrine rests on a simple but decisive idea: the security and military agencies are not the property of the ruler, but institutions of the state, the constitution, and society. At the same time, however, they do not become a political guardian above the people, nor an authority that decides who governs and who is removed.

العقيدة الجمهورية لا تعني "حكم الأجهزة"، بل تعني إخضاع القوة المسلحة للقانون بدل إخضاع القانون للقوة. ومعيار الأمن الجمهوري الحقيقي ليس الولاء للحاكم، وإنما احترام القانون وحماية المواطنين والمؤسسات، ورفض الانزلاق إلى التعذيب، أو المحاضر المفبركة، أو تصفية الخصوم أمنيا وتعطيلهم إداريا، ورفض التحول إلى أداة داخل الصراع السياسي، أو إلى جهاز يعمل بمنطق التعليمات الشخصية لا بمنطق القانون.

Republican doctrine does not mean “rule by the agencies”; it means subjecting armed force to the law rather than subjecting the law to force. The criterion of true republican security is not loyalty to the ruler, but respect for the law, protection of citizens and institutions, refusal to slide into torture, fabricated reports, the security liquidation of opponents and their administrative obstruction, and refusal to become an instrument within political conflict, or an agency that operates according to the logic of personal instructions rather than the logic of law.

أما تغيير السلطة السياسية، فيجب أن يبقى شأنا دستوريا ومدنيا وشعبيا، لا وظيفة للأجهزة. هذه النقطة بالذات أساسية اليوم في تونس.

As for changing political authority, that must remain a constitutional, civilian, and popular matter, not a function of the agencies. This precise point is essential in Tunisia today.

فالبلاد لا تحتاج إلى انقلاب جديد يبرر بإنقاذ الدولة، بل تحتاج إلى استكمال تحول هادئ نحو دولة جمهورية حقيقية، تكون فيها الأجهزة محايدة ومحترفة ومحصنة من التوظيف السياسي.

The country does not need a new coup justified in the name of saving the state. It needs to complete a calm transformation toward a true republican state, in which the agencies are neutral, professional, and protected from political instrumentalization.

وإذا كانت هناك رسالة ينبغي أن تصل اليوم إلى المؤسسة الأمنية، فهي التالية: حيادكم هو حمايتكم. وابتعادكم عن الانتهاكات هو الضمانة الوحيدة لمستقبلكم ولمستقبل الدولة. أما الانخراط في صناعة القمع والمحاضر والتعليمات، وحجب جوازات السفر وبطاقات السوابق العدلية، فلن يحمي أحدا على المدى الطويل. لقد تغير المجتمع التونسي. وتغيرت الدولة نفسها. وتغيرت نظرة الأمنيين إلى دورهم أيضا.

If there is a message that ought to reach the security institution today, it is this: your neutrality is your protection. Your distance from violations is the only guarantee for your future and for the future of the state. As for involvement in producing repression, reports, and instructions, and in withholding passports and criminal-record certificates, it will protect no one in the long run. Tunisian society has changed. The state itself has changed. Security personnel’s view of their role has changed as well.

وربما تكون هذه واحدة من أعمق التحولات التي أفرزتها الثورة التونسية، حتى وإن بقيت غير مكتملة ومهددة دائما بالانتكاس.
