Thirteen Years After the Outbreak of the “Revolution”: The Media in the Mirror of the 2024 Presidential Election
The essay argues that Tunisia’s post-2011 gains in media freedom remained shallow and legally fragile, allowing the post-2021 return of authoritarian control to expose the unfinished nature of the democratic transition.

From the country’s independence in 1956 to the departure of former president Ben Ali (1987-2011), and down to the present day, the conditions in which the media operate have depended on political upheavals, which in turn shift according to the events that shake the country. In a strong state, fashioned by Bourguiba from the 1960s onward,

The rupture brought about by President Ben Ali’s departure opened the way to a new political cycle. The decade from 2011 to 2021 would be marked by an explosion of political activity, with parties and political associations emerging thanks to a number of liberal provisions. Under these conditions, the media world would experience, during this decade, a period of freedom exceptional in the country’s history. The number of newspapers, radio stations, and television channels increased markedly. The newly acquired freedoms also allowed citizens and journalists to report the news and debate with complete freedom, though often without a clear direction. Television studios sometimes became genuine arenas of conflict among the various political actors.

Yet this “improvement” would gradually fade from 2021 onward, and for good reason: the reforms undertaken had no deep impact on the world of journalism or on the media sector. They did not succeed in establishing real safeguards against the exploitation of the “democratic transition” for political and personal ends. Moreover, the state’s role as promoter of these reforms receded significantly because of the multiplication of the interests and practices of private actors in the media sector, who hastened to penetrate its joints.

The internal quarrels that fragmented the political elite that had governed the country over the past decade (2011-2021), its repeated failures to reduce social insecurity and curb social injustice and corruption, and its responsibility for the misuse of the “revolution” also weighed heavily on the course and outcome of the 2019 presidential election.

As a result of the disappointment many Tunisians expressed toward the “democratic transition,” and the frustrations felt in particular by those whom the “revolution” had left behind, a new political figure with populist inclinations, Kais Saied, easily emerged in the second round of the 2019 presidential election. Saied represented the complete antithesis of the traditional elites that had governed the country since 2011.

Since July 2021, President Kais Saied has surprised the country by declaring a state of emergency, then seizing all the levers of power, ultimately acting as the “sole master on board.”

In this paper, we seek first to trace the spread and presence of the media during the 2024 presidential election, in comparison with their role during the previous electoral campaign (2019), when they were a decisive actor. We then consider the situation of the media today (2024), in order to examine the reasons for the failure, or fragility, of the achievements of the “democratic transition,” especially with regard to press freedom and the return of authoritarian and repressive practices by political power.
An Election Without Surprise, and a Media in Disarrayانتخابات غير مفاجئة وإعلام مرتبك

Since the launch of the political transition on January 14, 2011, electoral confrontations had been marked by enthusiasm and momentum among candidates. The multiplicity and diversity of candidacies (26 candidates in the 2019 presidential election) aroused voters’ interest, fueled divergent debates, crystallized opposing orientations, and pushed the media and social networks to follow and relay the candidates’ performances, sometimes even amplifying them. Polling institutes regularly presented their findings on voting intentions, maintaining an element of suspense, since the election’s outcome was not predetermined.

At the same time, however, throughout the 2019 electoral campaign, the major audiovisual media challenged the principles governing the campaign through their bias and their failure to respect neutrality and transparency. These failures reveal the successive dysfunctions of public policies toward the media.

Indeed, with the presidential electoral campaign of October 2024, the political context became more rigid under an absolute political authority and conditions that no longer guaranteed free, fair, and pluralistic competition. The 2024 election does not resemble its predecessors, at least those that followed the 2011 revolution. It witnessed a return to the authoritarian practices and repressive reflexes that had prevailed before the “revolution.”

Another example of the wretched state of freedoms is the condition in which media outlets and journalists operated during the 2024 presidential campaign. In the past, these outlets had enjoyed great freedom of tone and movement, and had been able to cover electoral campaigns with few notable restrictions. Television stations, under the supervision of the Independent High Authority for Elections, organized competitive debates among candidates that attracted broad interest from voters.

As for the 2024 election, national television, which was supposed to cover the electoral campaign, limited itself to broadcasting news from the Independent High Authority for Elections, brief flashes on the candidates’ campaigns, reports on voting operations, and miniature segments around the question, “If I were president?”

The deterioration of journalists’ working conditions today is due to the fact that freedom of expression and information, and the right of access to information, have been seriously undermined since 2022. Unconstitutional legal provisions weighing on journalists’ work and on the publication of opinions through social networks tend to restrict the space of expression and information.

In the absence of a Constitutional Court, the decree-law issued by the president of the republic, together with administrative orders and judicial decisions, has been enough to limit journalists’ room for maneuver, control circulation on social networks, and restrict the exercise of the right of access to information.

Decree-Law No. 54 of 2022, dated September 13, 2022, on combating crimes related to information and communication systems, is a model example of provisions that deprive people of liberty. It aims to control and suppress the publication of comments and documents on social networks under the pretext that they infringe on the rights of others. Article 24 provides: “Anyone who deliberately uses information and communication networks and systems to produce, promote, publish, send, or prepare false news, data, or rumors, or fabricated, forged, or falsely attributed documents, with the aim of infringing upon the rights of others, harming public security or national defense, or spreading terror among the population...” shall be punished by five years’ imprisonment and a fine of fifty thousand dinars. The prescribed penalties are doubled if the person targeted is a public official or equivalent. The abundance of vague terms in this text opens the door to varying interpretations by judges, who can initiate criminal proceedings and convictions against anyone found guilty under this decree “simply because he expressed his opinions.”

Other administrative and judicial measures have also been taken to prevent journalists from accessing sources of information in order to cover current events, thereby depriving citizens of the right to full information: on June 15, 2023, the speaker of the Assembly of the Representatives of the People announced that journalists would not be allowed to cover parliamentary committee meetings, and that information on committee work would be published only in official press releases, accessible through the Assembly’s website and its official page on social networks. In the wake of the major legal reforms launched by the first governments of the “revolution” in 2011, new legal provisions were put in place to govern the written press and the audiovisual sector. Yet these laws no longer appear to be in force after the imposition of the state of emergency. This does not mean they have been repealed. In practice, however, when legal proceedings are brought against journalists or citizens who have expressed their opinions in the press or on social networks, judges tend to rely on provisions from other legal texts, including recent ones such as Decree-Law No. 2022-54 of September 13, 2022, or older ones such as the Telecommunications Code, drafted under former president Ben Ali and containing a number of provisions that violate freedoms. In the same vein, the counterterrorism law adopted by the Assembly of the Representatives of the People in 2015 is used as a basis for criminalizing political activists and others. This law places constraints on freedoms in general and opens the door to every sort of abuse, including the classification of political opponents as “terrorists.”

In addition to a legal framework that tends to restrict freedoms of expression and control journalists’ work, the activities of the Independent High Authority for Audiovisual Communication are now completely frozen. It is no longer listed among the constitutional bodies in the 2022 Constitution. Worse still, it now operates under government control.

How did we move from a diverse and plural media landscape during the decade 2011-2021, despite the dysfunctions and abuses that marked it, to a context characterized by the narrowing of spaces for free expression and the conviction of journalists?
الأسباب كثيرة ومتشابكة. فهي ترتبط بتداخل عالم الإعلام مع السلطة السياسية منذ سنوات الاستقلال، كما تعود إلى ضعف وهشاشة مهنة الصحافة في تونس. فاليوم، يقف الصحفيون في غرف الأخبار في حيرة من أمرهم بسبب الاعتقالات التي تطالهم والقيود القانونية التي تثقل كاهل العديد منهم. والأكثر من ذلك، فإن أوضاعهم المادية وظروف عملهم آخذة في التدهور. ففي بعض المؤسسات، يتم دفع رواتب الصحفيين في وقت متأخر، كما تتكرر حالات الاستغناء عن الموظفين بسبب تراجع عائدات الإعلانات. لفهم أسباب هذا التدهور بشكل كامل، علينا العودة إلى العقد الذي أعقب ”الثورة“.
The causes are many and intertwined. They are linked to the entanglement of the media world with political power since the years of independence, and also to the weakness and fragility of the journalistic profession in Tunisia. Today, journalists in newsrooms stand bewildered by the arrests affecting them and by the legal restrictions weighing on many of them. More than that, their material conditions and working conditions are deteriorating. In some institutions, journalists’ salaries are paid late, and layoffs recur because of declining advertising revenues. To understand fully the reasons for this deterioration, we must return to the decade that followed the “revolution.”

The decade from 2011 to 2021 created great hopes among defenders of freedoms. In the field of media in particular, these aspirations produced the beginnings of reforms that strengthened freedom of information and communication, but they did not leave a deep mark on the world of journalists or on the media sector. Nor did these reforms succeed in establishing real guarantees against the risks of hijacking the democratic transition and abusing it for political and personal purposes. They remained either incomplete or weak because of the entanglement of actors with divergent interests who exploited the media, especially audiovisual media, to strengthen their political influence. This was due to the failure of government structures to launch and implement substantive reforms, because of the deep disagreements that tore apart the ruling elites, alongside the social, economic, and political crises that weighed upon the transitional phase.

In this regard, the mutual distrust among the various actors in the transitional process, on the one hand, and between rulers and ruled, on the other, together with the deterioration of the economic and social situation affecting the most deprived social groups, produced a strong feeling of resentment among broad segments of the population. This feeling reflects the disappointment and disillusionment that overtook them toward political elites of every orientation. That resentment was expressed at the ballot box: first through the success of independent candidates in the 2018 municipal elections, and then through the election of Kais Saied, the “essentially populist” candidate. 2011-2021: media embellishment without consequences.

In the aftermath of January 14, 2011, Tunisia moved quickly from a situation that had lasted 50 years, marked by the political authorities’ constriction of the media, to an unprecedented context of freedom in modern Tunisian history. For the first time, this condition of freedom and emancipation from political authority came from below, not by decision from the summit of the state. It came through a leaderless and programless popular will, represented in the undermining of the state and public institutions with the fall of former president Ben Ali (1987-2011). Yet Ben Ali’s departure and the arrival of new ruling elites did not help bring about a break with old practices, nor did they replace old institutions with new structures grounded in a reformist vision.

The media reform policy promoted by Tunisia’s first transitional governments (2011) highlights this stark contradiction. It casts light on the gap between the legal texts that were supposed to govern the media sector and their actual application by the various actors in the field. Let us first examine the principal provisions introduced since 2011, then identify the dysfunctions and deviations to which they gave rise.
Incomplete Liberalizationالتحرير غير المكتمل
في فجر العملية الانتقالية في عام 2011، تبلور إجماع واسع النطاق بين النخبة الحاكمة الجديدة على ضرورة تحرير وسائل الإعلام من قبضة الحاكمين وأن يخضع القطاع السمعي البصري للتنظيم المؤسسي وذلك من خلال هيئة عامة مستقلة.
At the dawn of the transitional process in 2011, a broad consensus took shape among the new ruling elite on the need to free the media from the grip of those in power, and to subject the audiovisual sector to institutional regulation through an independent public authority.
وهكذا، رأت الأحكام القانونية الجديدة المنظمة للصحافة المكتوبة والقطاع السمعي البصري النور في تشرين الثاني/نوفمبر 2011: التشريع المتعلق بالصحافة والطباعة والنشر (المرسوم بقانون رقم 115 بالجريدة الرسمية عدد 84 بتاريخ 4 نوفمبر/تشرين الثاني 2011)، والذي تمحور حول أربعة فصول تتناول على التوالي نظام المؤسسات الصحفية، ووضعية الصحفي المحترف، وحق التصحيح والرد، والمسؤولية الجنائية للصحفيين. المرسوم بقانون رقم 116 المؤرخ في 2 نوفمبر 2011 المتعلق بحرية الاتصال السمعي البصري الذي يكرس حرية الاتصال السمعي البصري ويوفر لأول مرة في تونس أداة لتنظيم الإعلام السمعي البصري، وهي الهيئة العليا المستقلة للاتصال السمعي البصري. ويمنح النص، المستوحى من التشريعات الفرنسية والبلجيكية في هذا المجال، الهيئة العليا صفة مدنية واستقلالية مالية، ويجعلها مسؤولة عن ”ضمان حرية وتعددية الاتصال السمعي البصري“ و”إعطاء موافقتها على تعيين الرؤساء التنفيذيين لوسائل الإعلام السمعية البصرية العمومية“.
Thus, new legal provisions regulating the written press and the audiovisual sector saw the light in November 2011: the legislation on the press, printing, and publishing (Decree-Law No. 115, Official Gazette No. 84 of November 4, 2011), organized around four chapters dealing respectively with the system governing press institutions, the status of the professional journalist, the right of correction and reply, and the criminal liability of journalists; and Decree-Law No. 116 of November 2, 2011, on freedom of audiovisual communication, which enshrines freedom of audiovisual communication and provides, for the first time in Tunisia, an instrument for regulating audiovisual media: the Independent High Authority for Audiovisual Communication. Inspired by French and Belgian legislation in this field, the text grants the Authority civil status and financial independence, and makes it responsible for “guaranteeing the freedom and pluralism of audiovisual communication” and for “giving its approval to the appointment of the chief executives of public audiovisual media.”

Moreover, in the constitutional text adopted on January 26, 2014, freedoms of opinion, thought, expression, information, and publication are guaranteed (Article 31), and “no prior censorship may be exercised over these freedoms” (Article 31). Likewise, the right to information and the right of access to information are guaranteed by the state, which “endeavors to guarantee the right of access to communication networks” (Article 32).

The media arena has expanded and diversified considerably since then, and freedom of opinion and expression has become a tangible reality, which constitutes the principal achievement of the “revolution.” The exercise of this freedom and the adoption of a liberal legal framework led to the emergence of many media outlets of different kinds.
The Gaps in Reformثغرات الإصلاح

Even so, the media improvements witnessed during the decade 2011-2021 remained relative, and highly fragile. On the one hand, the development of the legal and institutional framework did not produce the real reforms needed inside newsrooms or in the media landscape as a whole. On another, most media institutions were left without clear direction, and often yielded to the siren calls of ratings through noise and sensationalism. On yet another, the lure of money and the opacity surrounding the sources of funding for most private media pose a major threat to their independence.

A report on “the owners of private audiovisual media” indicates,

Furthermore, the Independent High Authority for Audiovisual Communication is unable to enforce its decisions to close channels and stations that broadcast without authorization. It cannot exercise its powers normally and implement its decisions if it is not supported in its approach by government structures. The only time the government intervened to close a television channel banned by the Authority, Nessma TV, was on the eve of the 2019 presidential election, by the government then in office. The channel’s director, Nabil Karoui, was a candidate in that election, and his main rival was none other than Youssef Chahed, the head of that government. But after political pressure, Nessma resumed broadcasting a week after its closure “with a pledge to regularize its situation.”

In most media institutions, the structures designed to strengthen and protect ethical and professional principles, such as editorial boards, editorial conferences, and editorial charters, are absent or ineffective. Because of the consequences of their dependence on political authority from the years of independence until 2011, the world of journalists is far from homogeneous. Moreover, journalists’ working conditions remain precarious both professionally and materially. Overly legalistic.
في عام 2011، كان من المفترض أن يكون المعيار القانوني الجديد الذي سيتم وضعه بمثابة حافز للإصلاحات الهيكلية اللاحقة في وسائل الإعلام بهدف جعلها تتماشى مع ”المعايير الديمقراطية“. وفي هذه العملية، أُدخلت أحكام ومفاهيم جديدة في الإطار القانوني دون أن تستوعبها جميع الأطراف الفاعلة ودون أن تؤدي إلى قطيعة لا رجعة فيها مع النظام الإعلامي السابق لما قبل 14 كانون الثاني/يناير 2011. وتشمل هذه الابتكارات: تنظيم القطاع السمعي البصري، والتنظيم الذاتي لوسائل الإعلام المطبوعة والإلكترونية، والشفافية المالية، وتحويل الهيئات الحكومية إلى وسائل إعلام للخدمة العامة، والفصل بين الإدارة وطاقم التحرير، وتحديد الخط التحريري.
In 2011, the new legal norm to be established was supposed to serve as a catalyst for subsequent structural reforms in the media, with the aim of bringing them into line with “democratic standards.” In this process, new provisions and concepts were introduced into the legal framework without being assimilated by all the actors, and without producing an irreversible break with the previous media order of before January 14, 2011. These innovations include regulation of the audiovisual sector, self-regulation of print and electronic media, financial transparency, the transformation of government bodies into public-service media, separation between management and editorial staff, and definition of editorial line.
غير أن هذه المقاربة لا تقتصر على مجرد تحويل هذه المفاهيم إلى معايير قانونية جاهزة للاستخدام، دون مراعاة عملية الاستيعاب.32Michel de Certeau : « On suppose rappelle-t-il, « qu’assimiler signifie nécessairement devenir semblable à ce qu’on absorbe, et non le rendre semblable à ce qu’on est, le faire sien, se l’approprier ou réapproprier ». Yet this approach cannot be reduced merely to converting these concepts into ready-to-use legal standards, without taking account of the process of assimilation.
وبالتالي، فإن الوضع يبدو قاتمًا. فالإصلاحات الهيكلية التي طال انتظارها في قطاع الإعلام لم تتحقق أو تواجه صعوبات في تطبيقها. ومن بين الأسباب التي تُقدَّم في هذا الصدد الميل في تونس ما بعد 14 كانون الثاني/يناير إلى تفضيل المعايير القانونية على حساب نهج براغماتي القائم على ظهور إرادة سياسية جديدة من جانب الدولة، ومؤسسات عامة قوية وذات مصداقية، وشركات إعلامية مهنية حقيقية مستقلة عن نفوذ السياسة والمال.
Thus the situation appears bleak. The long-awaited structural reforms in the media sector have not materialized, or are encountering difficulties in their application. Among the reasons advanced in this regard is the tendency, in Tunisia after January 14, 2011, to favor legal norms at the expense of a pragmatic approach based on the emergence of a new political will on the part of the state, strong and credible public institutions, and genuinely professional media companies independent of the influence of politics and money.

At the close of this presentation on the political and historical development of the media from independence to the present day, it is clear that any real reform must begin from the recognition that the entanglement of the media and political power constitutes the principal obstacle to their liberation and full development. In other words, the question of liberating the media will remain problematic so long as the media are unable to free themselves from the grip of political authority, and so long as independent bodies for media regulation and self-regulation remain incapable of replacing government structures. From this perspective, the experiences of the role of the media in countries that have undergone “democratic transitions” since the 1970s should have received sustained attention from Tunisian decision makers during the years of transition. The balance sheet of these experiences, and of the methodologies and models that accompanied them and developed within transitional contexts, could have illuminated the path for us and better guided the debate on the future of the media in Tunisia. Indeed, as the researcher Olivier Koch rightly noted, “the question of the role of the media in the transition from an authoritarian regime to a democratic state governed by the rule of law presents itself as such. It requires us to benefit from what has been learned from studies of different geographical areas and waves of democratization. It also means taking a position on the models used in the study of regime change and evaluating the methodologies used to study the media in transitional contexts.”
